
Lagos Lawyer and human rights
activist, Ebun Olu-Adegboruwa has filed a suit before a Federal High Court in
Lagos seeking an order of the court declaring Amina Zakari's position as acting
chairman of INEC illegal and unconstitutional and for her to vacate the office.
Mr. Adegboruwa is also seeking an
order the court that she should be restrained from presiding over any election
in Nigeria including the governorship elections in Bayelsa and Kogi states.
The action is premised on the fact
that the statutory tenure of Mrs. Maina as a member of the commission came to
an end on the 21st of July. She has not been reappointed by the President after
consultations with the Council of State. And no appointment has been sent to
the senate in that regard for confirmation.
Mrs. Amina Zakari was named acting
chairman of INEC by virtue of being a National Commissioner in INEC, a position
she legally lost on Tuesday, at the expiration of her tenure. A re-appointment
according to the legal practitioner, cannot be carried out by the President by
merely writing a letter but through consultations and confirmation by the
senate.
Mr. Adegboruwa is also submitting
that Mrs. Zakari cannot be independent as an INEC Chairman because of her
affinity with the President and the Governor of Kaduna State.
